Key Components of LMPC License Application & Documentation

The importers and manufacturers of pre-packaged commodities can acquire a LMPC Certificate. It facilitates quick and cheap movement of customs. Who Approves the LMPC Certificate?

A LMPC Certificate is usually granted by the controller of the office of the Legal Metrology Department in the state and by the director of the Legal Metrology in the central level. This entirely depends on the location of the business premises.

Why does an importer need an LMPC License?

The Legal Metrology Act states that all the importers of pre-packaged Commodity are obligated to acquire a pre-packed commodity registration. Rule 27 of the LMPC Act states that submitting an LMPC licence application to the appropriate authorities is required in order to get a licence for pre-packaged goods. Penalties are applied if the packaging of commodities rules has not yet been complied with before the items reach India. According to these regulations, importers are responsible for making certain required declarations on the pre-packaged goods' packaging.

What are the different types of LMPC Certificate?

Depending on which LMPC licence application is submitted, there are two different types of LMPC registrations that are permitted under the LMPC Rules.

The LMPC Licence for Importer Registration under Rule 27: This registration is for importers who do not add any additional packaging or labelling to the pre-packaged item before importing it and selling it in India.

LMPC Licence for Packer and Manufacturer Registration under Rule 27: This registration is necessary whether a business is producing and packaging its own products, or whether it is purchasing produced items from a third party and having them packaged under its own name.

What is the process to acquire an LMPC License?

Follow these steps to acquire an LMPC License:
  • Complete the Application form: The first and foremost step to obtain a LMPC License is to fill out the application form in online or offline mode. Most people prefer an online application for a hassle-free process. Furthermore, the nodal officer for licensing your business is the controller or officer of the respective Legal Metrological Department of your state.

  • Verify and submit the required paperwork: The subsequent and important step to acquire a LMPC License is to keep the relevant documents handy. The necessary documents are Memorandum of Association, Articles of Association, GST Registration and the identity proof of the business premises and the owner among others.

  • Paying the required fees: After the submission the application form along with the relevant documents, a registration fee is to be paid. This registration fee is Rs 500 for Manufacturers and Importers and Rs 100 for dealers and repairers.

  • Collecting your LMPC License: Keep in mind that the LMPC License application needs to be filled within 90 days from the date of import. The validity of the application is checked after it has been submitted. The regulating authority checks all the paperwork and pays a direct visit to the business location to confirm all the actions. If the officer approves the application, he or she issues the licence; otherwise, if any required documents are missing or the application is incomplete, the application may be returned. It takes between 7 to 10 days to finish the registration process.
